Update on ABIM Maintenance of Certification (MOC) Legal Developments

There has been movement in the ongoing legal challenges related to ABIM’s MOC program. While the matter remains under review and continues to evolve, the outcome could potentially influence how MOC requirements are structured or enforced in the future.

Division of Insurance Needs your Help!

As you know,  last November, the Division of Insurance finalized  the revised regulation which included changes to provider directory requirements.  The final regulation includes amendments to 211 CMR 52.00  section 15 (attached) to establish rules in response to the collection, storage, display, and auditing of network provider directory information in response to M.G.L. c. 176O, § 28, incorporating recommendations from the Provider Directory Task Force created by Section 4 of Chapter 124 of the Acts of 2019.   

Throughout the month of January, the DOI has held information sessions with carriers and providers to determine what additional guidance is needed to implement the regulation.  The DOI is seeking your feedback on the attached draft data collection document that was shared yesterday.  Particular areas of concern are around defining and collecting data on facility fees and provider availability, but comments on all aspects are welcome.  The DOI is asking for your feedback by Tuesday January 30th.  We apologize for the short time frame and would be grateful for any thoughts you have so that they can be incorporated into the final document.  The provider directory regulation applies to all providers that are listed in a carrier’s directory, so it is important that we get this right!

Federal Updates: Telehealth Prescribing of Controlled Substances

Quick Summary
  • The Drug Enforcement Agency (DEA) released two proposed federal rules for the prescribing of controlled medications via telehealth, while also extending the Public Health Emergency (PHE) flexibilities until fall 2023.

  • The DEA is holding public listening sessions on September 12 and 13 to seek further information on telehealth prescribing of controlled substances as it finalizes the proposed rules. The deadline to  is Monday, August 21.

  • The National Institute on Drug Abuse (NIDA) also released a Request for Information to solicit data on the effect of telehealth initiation of controlled substances. Comments are due on Thursday, August 31.
